Smacircle Limited Warranty

LIMITED PRODUCT WARRANTY FOR SMACIRCLE PRODUCTS

Smacircle warrants to the original purchaser that your Smacircle-branded device and accessories that are new (the "New Product(s)") shall be free from defects in materials and workmanship under normal use for a period of one (1) year from the date of purchase. The New Products shall be referred to herein as the “Product(s)”. The New Product Warranty Period shall be referred to herein as the “Warranty Period”.

ALWAYS inspect to ensure the product works properly every time before use. Warranty of this product does not cover any damages due to misuse.

Failure to follow the user(s) instructions on packaging and/or user(s) manual may result in damages of this product including but not limited to any user’s personal items, all of which are not covered under warranty of this product.

Use at your own risk. Manufacturer(s) and/or suppliers/agents are not responsible for any damages/repairs, loss to electronic items including but not limited to any user’s personal items directly and/or indirectly resulted in the use of this product. Damage(s) resulting from any use, misuse, accident, and normal wear and tear are understandably not covered under this product warranty nor be responsible by manufacturer(s) and/or suppliers/agents. ​

Smacircle LMT Ltd. provides a standard Limited Warranty for 12 months from the date of activating the product. This warranty gives you specific legal rights, and you may also have other rights which vary from country to country. Smacircle LMT Ltd. ONLY warrants products purchased from an authorized dealer. Any part of the product supplied by Smacircle LMT Ltd. and found in the reasonable judgment of Smacircle LMT Ltd. to be defective in material or workmanship will be repaired or replaced by Smacircle LMT Ltd. without charge for parts or labor. The product including any defective part must be sent to the Smacircle LMT Ltd. Service Center within the warranty period. The customer will pay for the expense of delivering the product to the Smacircle LMT Ltd. Smacircle LMT Ltd. will pay for the expense of returning the product to the customer.

This Limited Warranty describes the service available to you in the event your Product requires warranty service, and you may have additional protections under your local laws. This Limited Warranty does not cover and excludes damage to your Product:

1. Caused by abuse, misuse, neglect or commercial use.
2. Caused by improper charging, storage, or operation, including, without limitation, use contrary to the users’ materials, use exceeding specified height, weight and age limits, use on stairs, walls and curbs, or any extreme sport or exhibition use.
3. Caused by accident, collision, riding over obstacles, racing, fire, water submersion, high pressure water spray, freezing, earthquake, dropping, severe oxidation, or chemical solvent corrosion.
4. Caused by any repair that was unauthorized by Smacircle LMT.
5. Caused from improper packaging or mishandling during shipment to the warranty-service provider.
6. That is cosmetic, including, scratches, dents and the removal of protective coatings that are designed to diminish over time, unless such damage occurred due to a defect in materials.
7. Caused by the use of the Product with, or any modification to the Product using, any third party product, component or accessory that is not sold by Smacircle LMT.
8. That does not arise from Smacircle LMT’s product-design, technology, manufacturing or quality.

ALL LIMITED WARRANTIES ARE LIMITED IN THE DURATION TO THE WARRANTY PERIOD. AND SUCH IMPLIED WARRANTIES INCLUDING MERCHANT ABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR OTHERWISE, ARE DISCLAIMED IN THEIR ENTIRETY AFTER THE EXPIRATION OF THE APPROPRIATE WARRANTY PERIOD. SMACIRCLE LMT’S OBLIGATION UNDER THE WARRANTY IS STRICTLY AND EXCLUSIVELY LIMITED TO THE REPAIR OR REPLACEMENT OF DEFECTIVE PARTS AND RETURN OF THE PRODUCT TO THE CUSTOMER. SMACIRCLE LMT DOES NOT ASSUME OR AUTHORIZE ANYONE TO ASSUME FOR THEM ANY OTHER OBLIGATION. SMACIRCLE LMT ASSUMES NO RESPONSIBILITY FOR INCIDENTAL, CONSEQUENTIAL OR OTHER DAMAGES INCLUDING, BUT NOT LIMITED TO THE EXPENSE OF RETURNING THE PRODUCT TO SMACIRCLE LMT SERVICE CENTER, LOSS OF USE OF PRODUCT AND LOSS OF TIME OR INCONVENIENCE.

REMEDIES

If such a defect arises and a return authorization request is received by Smacircle within the applicable Warranty Period, Smacircle will, at its option and to the extent permitted by law, either (1) repair the Product at no charge, using new replacement parts or (2) replace the Product with a New Product. In the event of such a defect, to the extent permitted by law, these are your sole and exclusive remedies. Shipping and handling charges may apply except where prohibited by applicable law. These Limited Product Warranties are valid only in the jurisdictions where the Products are sold by Smacircle itself or through its authorized reseller or agent and is valid to the extent permitted by the applicable laws of such jurisdictions.

EXCLUSIONS AND LIMITATIONS

Smacircle does not warrant that the operation of the Product will be uninterrupted or error-free.
These Limited Product Warranties apply only to the original purchaser of the Product that was purchased from an authorized reseller or sales channel and manufactured by or for Smacircle that can be identified by an authorized “Smacircle” trademark, trade name, or logo affixed to it. Without limiting the foregoing, these Limited Product Warranties do not apply to any (a) Smacircle products and services other than the Products, (b) non-Smacircle products, even if included or sold with a Product, including, without limitation, any counterfeit products, (c) products that are, or Smacircle reasonably believes to be, stolen, (d) consumables (such as batteries), or (e) software, even if packaged or sold with the Product or embedded in the Product.

These Limited Product Warranties do not apply to a Product or part of a Product that has been serviced, altered, refurbished, or modified by anyone who is not authorized by Smacircle, nor does it apply to any cosmetic damage such as scratches and dents. In addition, these Limited Product Warranties do not apply to damage or defects caused by (a) use with non-Smacircle products; (b) accident, abuse, misuse, mishandling, flood, fire, earthquake or other external causes; (c) normal wear and tear or aging of the Product such as discoloration or stretching; or (d) operating the Product (i) outside the permitted or intended uses described by Smacircle, (ii) not in accordance with instructions provided by Smacircle, or (iii) with improper voltage or power supply.

No Smacircle reseller, distributor, agent or employee is authorized to make any modification, extension, or addition to these Limited Product Warranties. If any term contained herein is held to be illegal or unenforceable, the legality or enforceability of the remaining terms shall not be affected or impaired.

CUSTOMER INQUIRIES

If your Smacircle Product is not operating, please refer to your User Manual before contacting our Customer Service Center. For any damage or repair work required, please do not return your product to the store where it was purchased.

RETURN / REPAIR POLICY

Customers must call our Customer Service Center and ask for a Return / Repair Authorization Number before sending the product to the Service Center. Returned products must be shipped with original packaging including the polystyrene packing material and all defective parts. Please contact our Customer Service Center for assistance in handling your case.

RETURN / REPAIR PROCEDURE

For further assistance to better provide the most convenient product warranty support please provide us the following information when contacting us: Product Owner complete legal name. Product Model Name Product Serial Number Proof of purchase date from authorized retailer (receipt)

1.Call Customer Service Center for your local return location address of USA: +1-800-990-9253. For countries outside USA, please check your local distributor phone number. For the area there is no distributor, please email support@smacircle.com for assist.
2.Customer Service Center will provide a Return/Repair Authorization number.
3.Make a copy of your proof of purchase receipt
4.Pack the defective unit in its original packaging including the polystyrene foam and include the unit and all defective parts.
5.Attach the copy of your Proof of Purchase (receipt) to the outside of the box (clearly visible), together with the Return / Repair Authorization Number.
6.Ship the package to the Service Center.

PLEASE NOTE: Deliveries that do not have the Proof of Purchase (copy of receipt) and Return / Repair Authorization Number attached clearly to the outside of the box, will not be accepted by the Service Center.

IMPORTANT: Customers must call customer service center and ask for the return authorization number before sending the product to the service center. Returned products must be shipped with original packaging including the polystyrene material and all defective parts.

WARRANTY REGISTRATION For faster service please register your New Smacircle E-mobility after purchase. Please fill in all information, and upload a copy of your Proof of Purchase Receipt.

IMPLIED WARRANTIES

EXCEPT TO THE EXTENT PROHIBITED BY APPLICABLE LAW, ALL IMPLIED WARRANTIES (INCLUDING, WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE) SHALL BE LIMITED IN DURATION TO THE DURATION OF THE APPLICABLE WARRANTY PERIOD. Some jurisdictions do not allow limitations on the duration of an implied warranty, so the above limitation may not apply to you.

LIMITATION OF DAMAGES

EXCEPT TO THE EXTENT PROHIBITED BY APPLICABLE LAW, SMACIRCLE SHALL NOT BE LIABLE FOR ANY INCIDENTAL, INDIRECT, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING, WITHOUT LIMITATION, LOSS OF PROFITS, REVENUE OR DATA, RESULTING FROM ANY BREACH OF EXPRESS OR IMPLIED WARRANTY OR CONDITION OR UNDER ANY OTHER LEGAL THEORY, EVEN IF SMACIRCLE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Some jurisdictions do not allow the exclusion or limitation of special, indirect, incidental or consequential damages, so the above limitation or exclusion may not apply to you.

GOVERNING LAW

These Limited Product Warranties shall be governed by and construed in accordance with the Law of the People's Republic of China without regard to its conflict of laws principles.
